Terms of Service

Overview:
Acceptance by www.tcm-vet.com (“Seller”) of your (“Buyer”) order is expressly conditioned on Buyer’s agreement to these terms and conditions. The terms and conditions stipulate that Buyer’s Application, Order Confirmation and All Transactions shall apply to all transactions between Buyer and Seller. Seller expressly rejects any term or provision that states any standard, specification or damage related to quality and delivery time, or that contradicts or is intended to supersede these terms and conditions. By requesting www.tcm-vet.com to make the goods available to you, you acknowledge and agree (or you are deemed to acknowledge and agree) to these terms and conditions of purchase.

1. Payment and Order Transactions
   Unless otherwise agreed in writing, payment shall be made at the time of placing the order by credit card, debit card, money order, etc. on file with the buyer or by the payment method provided by us.
   Seller may reject or cancel any order or delivery of goods at any time by notifying Buyer in writing (any contact form); Seller shall not be liable for any loss or damage resulting from such cancellation. .
   Once an order has been submitted, you cannot cancel it. All sales are final.
   Any changes to any order must be agreed in writing. The total price is subject to any change and the buyer agrees to pay any increase.
   Restocking Fee: Seller reserves the right to charge a restocking fee. Buyer shall pay 20% restocking/cancellation fee. Restocking fees will be charged to the credit card on file at the time of transaction, or by the method we designate.
   Title to the Goods shall pass to you upon payment in full of the purchase price for the Goods.
2. Duties/taxes/fees
   All import and export documents, licenses, duties, taxes or other obligations or charges in connection with the delivery of the goods shall be borne by the buyer.
3. Merchandise resale
   Resale of Seller’s products at low prices on any public forum, e-commerce receipt or website is expressly prohibited, and Seller reserves the right to determine in its sole discretion which public forums, if any, are eligible for buyer resale.
4. For orders within the United States: Unless otherwise agreed in writing, the seller will arrange for the goods to be delivered to you and you will be responsible for the costs associated with the delivery. Orders will be shipped via FedEx, USPS, UPS, DHL, etc. Although the delivery service used by Seller may include insurance for the goods in transit, Seller makes no representations or warranties regarding such insurance and you will be responsible for obtaining any specific insurance you require in connection with the goods in transit. The risk associated with the goods passes to you when the goods are delivered to the carrier.
   For international orders: Unless otherwise agreed in writing, you are responsible for the cost of shipping the goods from the seller’s premises. The risk associated with the goods passes to you when the goods are made available to the delivery carrier. It is your responsibility to insure the goods from the date they are received at the place of delivery (carrier).
5. Defects
   The buyer must file a shortage claim within the first 7 days of receiving the item. Claims other than shortages are not supported. The seller is not responsible for shortages when the goods are shipped to third parties. It is the buyer’s responsibility to check upon receipt that all delivered goods correspond to what was ordered.
   If a portion of an order is delayed, or if a portion of an order is in short supply, the order can only be remedied for that portion of the order.
   Buyer waives acceptance of goods known to be defective, and Buyer hereby waives any claim for damages arising from any defect known to Buyer at the time of acceptance of the goods, including late delivery.
6. Disclaimer of Liability by Seller
   Buyer accepts that this product has not been evaluated by the Food and Drug Administration (FDA), that this product is a traditional herbal food (supplement), (plant) food, and is intended for use by pets (dogs and cats) only.
   The buyer acknowledges that all the seller’s publicity is for education and science popularization. All of Seller’s products are not intended to replace veterinary medicines, nor are they intended to be used in the treatment, prevention or diagnosis of any disease.
   All herbal products are herbal supplements or pet food and are traditional herbal (plant) foods; any claims related to effects and side effects are not supported. All orders agree to these terms.
7. Return
   It is the buyer’s responsibility to inspect upon receipt that all deliveries accurately reflect the goods purchased.
   In some cases, unused unsatisfactory items may be replaced with all tags in their original packaging. Products are eligible for return or exchange at the sole discretion of Seller. All exchanges must be initiated within 7 days of receipt of item.
   In the event of an exchange of goods, the buyer is responsible for all shipping costs for the return of the product to the seller and the delivery of the new product to the buyer. Buyer authorizes Seller to sell any Products that are exchanged, rejected or abandoned.
   If you modify a product, you will immediately be ineligible for a return or exchange. Once the goods are damaged, soiled, soaked in water, unpacked, etc., the buyer cannot return the goods or make a claim related to such goods. No responsibility for dust or damage during shipping.
8. Seller does not warrant that the quality, weight, design or color of the merchandise will match any particular described image or sample. Packaging and language may vary when shipping to different countries; however, the overall design style is the same.
9. Intellectual property rights
   The buyer shall not damage the good reputation, goodwill and image of the product brand sold by the seller in any form.
   The buyer shall not infringe or damage the design copyright and graphic copyright of the seller’s website and products.
10. The seller shall not be liable for the following
    Buyer alters or modifies the product, misuses the product, uses or handles it in an unusual or non-recommended manner.
    Defects in any goods manufactured by any third party.
    Loss or damage caused in whole or in part by any factor beyond our control, including but not limited to any loss caused by delay in the production or supply of goods.
    indirect or consequential damages of any kind.
11. Deterioration of buyer’s credit
    Seller reserves the right to terminate any delivery or suspend further deliveries of other goods. If the buyer’s financial situation is not satisfactory to the seller, the seller may demand payment in cash for delivery of the goods.
    If the buyer’s reputation deteriorates, the seller will reduce the buyer’s credit or close the buyer’s account, and stop subsequent cooperation and transactions; the seller will not bear any responsibility.
12. The Seller may modify or replace these terms and conditions from time to time. On any order placed after such modification, you agree to be bound by the modified terms and conditions.
